I see most other similar e-bikes say their max speed is about 26-28 mph range, so I wonder if this bike's claim of 36 mph top speed is actually true & accurate?
So no, pedals haven't automatically made a vehicle a legal bicycle for 4 decades.
This is, in legal terms, a motorcycle/scooter in some states. The max speed for an ebike is 28mph. Anything more is a moped. Somewhere in the low 30s there is a line to motorcycle/scooter. At 36mph, this is likely a scooter/motorcycle, so license, registration, insurance in pretty much every US state.
And even a 28mph ebike is illegal to use on public roads in many places or may require being licensed/registered/insured.
And then the sheer mass of it. This beast weighs 82lbs! This will destroy bike racks! Actual bicycles don't have a double-tree front end or twin-tube construction. Its all singular tubes to cut down weight (and make it easier to pedal). A proper e-bicycle won't have a motorcycle-style ball headlight or decorative side panels or a faux-gas-tank, all of which add weight.
So no, you won't get any exercise on this bike. Go to Walmart, buy an inexpensive Ozark Trail e-bike.
Oh, sweet summer child, pedals don't make a moped a legal bicycle. Over-powered mopeds have existed for decades in violation of the law. Yes, waaaay back in the 1980s (40 years ago!), pedals and a motor of any size were legal. That stopped after they put pedals on 125cc motorcycles and at around the same time sold 3-wheeled ATVs in the age before cheap helmets and there were a ton of kids with brain damage, paralysis, and cases of being dead.

In California, pedals alone don't make it legal. Motor power and mph is what you need to consider. The following classes are the only ones permitted on public roads.
Class 1 E-Bikes: These are pedal-assist bikes with no throttle. The motor provides assistance only when the rider is pedaling, and this assistance stops when the bike reaches 20 mph.
Class 2 E-Bikes: Equipped with a throttle, these bikes can propel the rider without the need for pedaling up to 20 mph.
Class 3 E-Bikes: These are pedal-assist bikes without a throttle. The motor provides assistance only when the rider is pedaling, with the assistance stopping at 28 mph.
California limits the maximum motor power of all e-bikes to 750 watts. These are pretty much ILLEGAL in California.
Class 1 & 2 E-Bikes: You can use bike lanes and paths pretty much everywhere. Some places may allow you on sidewalks, but check local rules.
Class 3 E-Bikes: You can use bike paths if local laws say so, but mostly, you'll be riding on roads and bike lanes. Sidewalks? Not unless the city says it's cool.
It works the same way for things like generators and other electrical power items. A 3500 watt (continuous) generator may advertise a 'peak' wattage of 4500 watts, but the actual true rating IS 3500 watts. The 4500 momentary 'peak' watt output often can't be sustained even beyond a second or two.
So if you have a 750 watt motor on your ebike, you are looking at the same thing with this bike. This Gweit ebike is also a 750 watt (continuous) rated motor. Not sure why TLJester and SplendidSpaniel871 got a downvote, as they are both correct.
