Macy's is running a background check on my 6 year old child, is that legal?

1,739 1,234 February 9, 2011 at 09:19 AM in Chat
So this past christmas my 6 year old was hurt at macy's when a display shelf came crashing down.

Today is the 1st time they contacted me.

The wanted to know about a car accident we had 3 months ago.

How the hell do they know my 6 year old was in a car accident unless they ran a background check.

Any ideas?

And no trolls, I'm not looking for legal advice, I'm looking for the database that Macy's used to check on my child.

Thanks!

They probably got the police report which is a public record.

A "slip and fall" at McDonalds?

"Let it go?"

This leads me to believe you contacted someone in management because your 5 year old fell down. The local businesses probably have constructed a database to protect themselves from... dubious... claims from you.

From an injury that happened only a little while beforehand?

That's odd.
My child was fine in the mcdonalds incident, mcdonalds took a report and that was it. We did nothing else.

In the macy's incident she had brusing the next day and my wife took her to the doctor.

I'm just wondering how the hell macy's knew abt the mcdonalds incident in no claim was ever filed.

My question is why a report was filed with McDonalds in the first place if your child was fine.

Plus, they also asked about a slip and fall at mcdonalds last year, she was not injured and we just let it go.

Now how the hell do they know about that if a claim was never filed?

Yes the macy's store manager filled out a report and yes, my child did have a brusing on her arm and shoulder.

Today is the 1st time they contacted us.

McDonald's probably insisted on it to cover themselves in case of litigation.

I got it! I got it!

The McDonalds manager was fired because the lettuce washer didn't do his job (damn Nagin), then he applied to be the Macy's manager, and while working as the Macy's manager got into a car accident with you last month.

Insurance industry keeps track of all insurance claims ever made in what's called an ISO database. Your boy's SSN, address, parents' name, it all comes up.

This is standard procedure. Don't worry so much. Now, if your son has same or similar injuries in the two incidents, that might affect their settlement offer.

FTS. Filing a claim means wasting my time = free stuff. If I don't get something big out of it, fark them for trying to cover their asses.

What are they going to do? Call the cops for me walking out and not giving them my personal info if I'm fine? Roll

my question is why do you keep filing claims when your child falls? and how many times have you been paid out from incidents like this?

Was your child playing on the display, climbing on it or the like?

Well they probably could have refused to give the information for the claim.

When I was a kid I fell on metal stairs at a Burger King playground and cut my gums really bad. I had to be taken to the ER and almost had to get stitches but it was just below the minimum depth for them. We never filed a claim at BK or tried to even get the medical bills paid for. Amazing how times have changed now where any little accident turns into litigation.
