Macy's is running a background check on my 6 year old child, is that legal?

So this past christmas my 6 year old was hurt at macy's when a display shelf came crashing down.

Today is the 1st time they contacted me.

The wanted to know about a car accident we had 3 months ago.

How the hell do they know my 6 year old was in a car accident unless they ran a background check.

Any ideas?

And no trolls, I'm not looking for legal advice, I'm looking for the database that Macy's used to check on my child.

Now, it's conjecture. Sure, things can be leaked. But, as I've stated, we're not talking about the medical records of a famous person here that may have value. Why would any office or office employee risk going to jail for releasing the records without authorization?

As far as medical facilities throwing out stuff, that's not plausible too. Because, privacy laws REQUIRE that ALL medical records be shredded. The facility can't just throw it in the trash!

As far as what's written on FB, then that's not unauthorized access to a patient's medical record, right? And, that's what we're talking about. That is, you gave me a retort regarding my statements that it's pretty hard for a stranger to get a person's medical records. And, you stated that what I said was "BULLs*it". Now, you're going off track and are talking about what someone could write on FB or whatever.

Do you just like to go against ppl and talk out of your a$$? When you really don't have any clue what you're talking about?

I think the OP mentioned the possibility of Macy's acquiring her child's medical record. I was just commenting on the difficulty of doing that. Possible? Yes. But, it's pretty hard now with all the federal laws protecting patient privacy.

Yeah, but how can a PI or ex-cop acquire a patient's medical record? How can a PI convince a medical facility to forgo the risk of fines and prison to accommodate his/her request for the medical records?

You also keep bringing up sealed juvenile records. They are sealed. And sure, lawyers and cops can get a hold of them. However, they can't be used in court unless the judge allows it. But more importantly, we're not talking about juvenile records. We're talking about medical records.

I have a little more insights on the matter because I work in the health field. And, I run a facility.

No you assume that your medical records is somehow secure, and I dispute such claims.. that nothing is secure...

If the OP mention that somehow Macy got info on his girl's medical record, you should ask him how , not me... Cause somehow they got hold of some info, and I know for a fact if anyone needed to with enough resources will be able to get anyone infos be it all or tidbits... Be it official documents or just by word of mouth...

Cause it was enough info to spook the OP, so I saw Macy did their job, to fend off a potential lawsuit... Even if the OP file a complaint and say Macy got hold of his info, how he's going to prove it.. Its not like Macy shoved a official copy of anything in his face.

Fine. You can "dispute" it all you want. But, I contend that it's very difficult nowadays to gain access to another person's medical records. To gain such access, it's illegal and a federal crime. The person who released the records WILL be fined and receive a jail sentence. Also, the facility will be fined a minimum of $10k per offense.
