Yesterday my house got robbed and I sent 3 kids to kiddie jail and one home for a spanking!

My House was robbed by 4 kids. OMG One was only eight years old. The 8 year old boy cracked under pressure and told his mommy what he had done. I got most of my stuff back, but not all of it. I'm out $700 to $800 in odds and ends. Some of the stuff that is still missing is stuff that can never be replaced. I'm very sad & pissed off! Please say a little prayer that I get the rest of my stuff back. Crying

Already talked to the investigator, he said it makes no deference that it was unlock its still braking and entering. I will turn over the list to the investigator and he will put it to the judge for restitution. nod

Sad thing is I don't think they have any money to make restitution.

Maybe the judge can get them to confess what they did with the jewelry and you can try to get it back. Comfort

Do you have x-ray vision?

Do you know if the "children" are unarmed? Should I wait until they start shooting at me with their stolen guns before I return fire?

In my opinion, children cease to be children when they're committing crimes like grand larceny. Just my opinion.

First of all it will be small claims court (according to the price she put on the items) so a jury will not be on the case. It will be heard before a judge, who will either have the parents of the boys work out a payment plan with the victim OR she'd throw out the case since the value of the items is so low and because they didn't actually break into the home because the victim left the door unlocked.
First - you have the right to a jury when the claim exceeds $20. I think it's somewhere in that sheet of paper those dudes scribbled on a while ago.

Second - I'm not sure what you mean by the value of the items being so low. They stole over $2,000 in goods. That's felony grand larceny. Depending on the laws, if the DA wanted to be an ass, he could probably get them for possessing a firearm in the commission of a crime due to them stealing the BB gun. This depends on what's considered a firearm in her state, though.

Third - It doesn't matter if a door is locked or unlocked. You cross that plane without being invited, and it's burglary (or breaking and entering). No question. If someone's home, it's a home invasion. That's like saying a car's fair game because someone left it running in their driveway.

If I was home, I more then likely would have shot first and asked questions later.

If you have the time, you might want to go round to the pawn shops in your town and see if you can find the jewelry. If it is at a pawn shop, the police will confiscate it and return it to you once the trial is over.
