Official Rules
NO PURCHASE OR APPLICATION NECESSARY TO ENTER OR WIN. A PURCHASE OR APPLICATION OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Eligibility: The Home Depot Commercial Card Ford Truck Sweepstakes (the "Sweepstakes") is open only to legal residents of the fifty (50) United States, the District of Columbia, who are at least eighteen (18) years old at the time of entry, and open only to legal residents Puerto Rico who are at least twenty-one (21) years old at the time of entry. Employees of Citicorp Credit Services, Inc. (USA) ("Sponsor"), The Home Depot U.S.A. Inc., ePrize, LLC, and their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. All commercial accounts issued to government agencies are excluded and will not be eligible to participate in this Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's and Administrator's decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.
2. Sponsor: Citicorp Credit Services, Inc. (USA), 50 Northwest Point Blvd., Elk Grove Village, IL 60007. Administrator: ePrize, LLC, One ePrize Drive, Pleasant Ridge, MI 48069.
3. Timing: The Sweepstakes begins on May 1, 2012 at 12:00 a.m. Eastern Time ("ET"), ends on July 31, 2012 at 11:59 p.m. ET (the "Promotion Period"). Administrator's computer is the official time-keeping device for the Sweepstakes
4. How to Enter: There are three (3) ways to enter the Sweepstakes as outlined below:
a) Apply for a Card: During the Promotion Period, if you do not already have The Home Depot Commercial Revolving charge card, or The Home Depot Commercial Account, you can apply either at a Home Depot store or online at HomeDepot.com. Upon submission of your application you will receive one (1) entry into the Sweepstakes.
b) Make a purchase: During the Promotion Period, make a purchase using your The Home Depot Commercial Revolving charge card or The Home Depot Commercial Account, either at a Home Depot store or online at HomeDepot.com. For every one (1) transaction, you will automatically receive one (1) entry into the Sweepstakes. The primary account holder of the Home Depot credit card used to make the purchase will receive the Sweepstakes entry. For joint accounts, only one (1) Sweepstakes entry will be awarded to the card associated with the transaction. Cash advances are not eligible.
c) Mail-in: During the Promotion Period, hand print your name, address, day and evening phone numbers, email address, and date of birth on a 3" x 5" piece of paper and mail it in an envelope with proper postage to "The Home Depot Commercial Card Ford Truck Giveaway- AMOE," c/o Department 583773, P.O Box 5046, Kalamazoo, MI 49003-5046. Upon receipt of your entry, you will receive
six (6) entries into the Sweepstakes. Limit: One (1) mail-in per envelope. You may enter the Sweepstakes via this method as many times as you would like. All mail-in entries must be handwritten and must be postmarked by July 31, 2012 and received by August 7, 2012. All entries become the exclusive property of Sponsor and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due entries, which will be disqualified.
Multiple entrants are not permitted to share the same email address or Home Depot credit card account. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate and use of any other means to subvert the entry process is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address and/or the Home Depot credit card used to register will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address or the primary account holder listed for the Home Depot credit card. Each potential winner may be required to show proof of being the authorized account holder.
5. How to Opt-Out of this Sweepstakes: If you make a purchase using your The Home Depot Commercial Revolving Charge card and/or The Home Depot Commercial Account and/or apply for a The Home Depot Commercial Revolving Charge card and/or The Home Depot Commercial Account during the Promotion Period and do not wish to participate in this Sweepstakes, you may opt-out of participating in this Sweepstakes only by mailing a 3" x 5" piece of paper, with proper postage, including your name, address, and email address, to "The Home Depot Commercial Card Ford Truck Giveaway – OPT-OUT," c/o ePrize, LLC, PO Box 790340, St. Louis, MO 63179, and you will not be included in the drawings for this Sweepstakes.
6. Prize Drawings: Administrator is an independent judging organization whose decisions as to the administration and operation of the Sweepstakes and the selection of the potential winners are final and binding in all matters related to the Sweepstakes. Administrator will randomly select the potential Sweepstakes winners from all eligible entries received during the Promotion Period, on or around 8/13/12. The potential winners will be notified by phone or mail. Except where prohibited, each potential Prize winner (or parent/legal guardian if winner is a minor in his/her state of residence) will be required to sign and return a Declaration of Compliance, Liability and Publicity Release which must be received by Administrator, within seven (7) days of the date notice or attempted notice is sent, in order to claim his/her prize. If a potential winner of any prize cannot be contacted within a reasonable time designated by Administrator, or fails to sign and return the Declaration of Compliance, Liability and Publicity Release within the required time period, the potential winner forfeits his/her prize. Receiving a prize is contingent upon compliance with these Official Rules. In the event that a potential winner of any prize is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries from the Promotion Period. Only five (5) alternate drawings will be held, after which the applicable prize will remain un-awarded. The Grand Prize winners will be contacted regarding the fulfillment of the prize within 8-10 weeks of the conclusion of the Sweepstakes and the prize will be fulfilled by the designated
dealership as soon as it becomes available. All other prizes (except First Prize) will be fulfilled approximately 8-10 weeks after the conclusion of the Sweepstakes.
7. Prizes:
THREE (3) GRAND PRIZES: A 2012 Ford F-150 Lariat and $16,150 check to help cover taxes. Sponsor will determine all features of automobile including but not limited to color of exterior and interior, and all other features or upgrades will be allowed only if permitted by delivery dealer and paid for by Grand Prize Winner. Grand Prize Winner must be a licensed driver and will be required to provide proof of insurance at time of delivery. Grand Prize Winner must take delivery of prize from the automobile dealership designated by Sponsor and allow 4-6 weeks for delivery of the Prize Vehicle. Grand Prize Winner will be solely responsible for all car title, license and registration fees, freight, delivery, dealer prep, emissions inspection, additional equipment, all federal, state and local taxes, insurance, gasoline, vehicle maintenance and all other fees and expenses associated with the receipt and use of the Prize vehicle. Grand Prize Winner will be responsible for insuring and registering the Prize Vehicle. The Grand Prize Winner is not eligible for any cash rebate programs. The Grand Prize Winner agrees that Sponsor has neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Prize Vehicle, including but not limited to its quality, mechanical condition or fitness, except the Grand Prize vehicle does include Ford's standard vehicle limited warranty as set forth in the vehicle's Owner's Guide. Prize is non-transferrable. Approximate Retail Value ("ARV"): $59,150. Total ARV of Grand Prizes: $177,450.
ONE (1) FIRST PRIZE: Winner's choice of one (1) of the following trips:
a) A trip for two (2) to Las Vegas, NV. Trip package includes round trip, coach-class air transportation for two (2) from a major airport near winner's home (determined by Sponsor in its sole discretion) to Las Vegas, NV; three (3) nights' accommodations at The Cosmopolitan of Las Vegas (single room, double occupancy); The Other Side of Vegas "Las Vegas VIP Tour" for four (4) hours; ground transportation to and from airport and hotel; and $500 spending money. ARV: $6,700.
b) A seven (7) day cruise for two (2). Trip package includes round trip, coach-class air transportation for two (2) from a major airport near winner's home (determined by Sponsor in its sole discretion) to Miami, FL; seven (7) nights' accommodations aboard the Norwegian Epic (mini suite, double occupancy); ground transportation to and from airport and cruise ship; three (3) on-board meals per day, some beverages are included; and $200 spending money. Prize does not include alcoholic beverages, gratuities, excursions, government fees or taxes. ARV: $6,580.
c) A trip for two (2) to New York City, NY. Trip package includes round trip, coach-class air transportation for two (2) from a major airport near winner's home (determined by Sponsor in its sole discretion) to New York City, NY; two (2) nights' accommodations at Waldorf Astoria (single room, double occupancy); ground transportation to and from airport and hotel; $350 spa allowance for winner and guest; a shopping experience with personal shopper, Andy Paige for
two (2) hours; car service for six (6) hour shopping excursion; and $500 spending money. ARV: $6,650.
d) A trip for two (2) to San Juan, Puerto Rico. Trip package includes round trip, coach-class air transportation for two (2) from a major airport near winner's home (determined by Sponsor in its sole discretion) to San Juan, Puerto Rico; four (4) nights' accommodations at the Wyndham El Conquistador Resort and Spa (single room, double occupancy); and ground transportation to and from airport and hotel; and $2,000 spending money. ARV: $6,250.
e) A trip for two (2) to Montego Bay, Jamaica. Trip package includes round trip, coach-class air transportation for two (2) from a major airport near winner's home (determined by Sponsor in its sole discretion) to Montego Bay, Jamaica; four (4) nights' accommodations at the Breezes Resort, Spa and Golf Club at Runaway Bay all inclusive resort (single room, double occupancy); and ground transportation to and from airport and hotel; and $1,400 spending money. ARV: $6,430.
f) A trip for two (2) to Whistler, British Columbia. Trip package includes round trip, coach-class air transportation for two (2) from a major airport near winner's home (determined by Sponsor in its sole discretion) to Vancouver, Canada; four (4) nights' accommodations at the Whistler Hilton (single room, double occupancy); three (3) day lift tickets for two (2) people; allowance for rental high pro ski set for three (3) days for two (2) people; a $350 allowance for rental car; and $1,500 spending money. ARV: $6,510.
g) A trip for two (2) to Steamboat Springs, CO. Trip package includes round trip, coach-class air transportation for two (2) from a major airport near winner's home (determined by Sponsor in its sole discretion) to Steamboat Springs, CO; four (4) nights' accommodations Steamboat Grand Hotel (single room, double occupancy); three (3) day lift tickets for two (2) people; and allowance for rental equipment for three (3) days; and $1,500 spending money. ARV: $6,450.
h) A trip for two (2) to West Palm Beach, FL. Trip package includes round trip, coach-class air transportation for two (2) from a major airport near winner's home (determined by Sponsor in its sole discretion) to West Palm Beach, FL; four (4) nights' accommodations at Palm Beach Golf Resort and Spa (single room, double occupancy); one (1) fifty (50) minute massage per person, or couples massage; and $500 allowance for additional spa treatments and green fees for golf; and $2,000 spending money. ARV: $6,360.
i) A trip for two (2) to Napa Valley, CA. Trip package includes round trip, coach-class air transportation for two (2) from a major airport near winner's home (determined by Sponsor in its sole discretion) to San Francisco, CA; four (4) nights' accommodations at Fairmont Sonoma Mission Inn and Spa (single room, double occupancy); a $450 allowance for rental car; and a $750 per person gift certificate from Willow Stream Spa and $1,200 spending money. ARV: $6,600.
For all trip options: Winner must complete the trip within one (1) year from the drawing date or prize will be forfeited. Trip must be booked at least twenty-one (21) days prior to departure. Trip subject to availability and blackout dates. Travel must be round trip. Sponsor will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel
and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by the Sponsor's airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Unless child of winner, travel companion must be eighteen (18) years of age or older as of the date of departure or a sibling/friend of winner with the appropriate parental permissions and releases and must travel on same itinerary and at the same time as the winner. If winner is a minor in his/her state of residence, travel companion must be winner's parent/legal guardian. Travel companion must execute liability/publicity releases prior to issuance of travel documents. Winner and travel companions are solely responsible for obtaining valid passports and any other documents necessary for international travel. Travel restrictions, conditions and limitations may apply. If in the judgment of Sponsor air travel is not required due to winner's proximity to prize location, ground transportation will be substituted for round trip air travel at Sponsor's sole discretion. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Sponsor is not responsible if any listed activity is delayed, postponed or cancelled for any reason, in which event that portion of prize is forfeited in its entirety and no substitution will be provided except as in Sponsor's sole discretion. Actual value of each trip may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value. If any portion of the prize or prize component is not used, that portion will remain unawarded. Winner will not be compensated for any unused prize components.
ONE HUNDRED FIFTY (150) SECOND PRIZES: DEWALT DC970K-2 18-Volt Drill/Driver Kit. ARV: $150. Total ARV of Second Prizes: $22,500.
ONE HUNDRED FIFTY (150) THIRD PRIZES: A $100 The Home Depot gift card. ARV: $100. Total ARV of Third Prizes: $15,000.
FIFTY (50) FOURTH PRIZES: A $100 Visa gift card. ARV: $100. Total ARV of Fourth Prizes $5,000.
For all prizes: Terms and conditions of gift cards/certificates apply. Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor's sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning a prize depend on the number of eligible entries received during the Promotion Period. Limit: One (1) prize per person. Total ARV of all prizes: $226,650
8. Release: By receipt of any prize, winners agree to release and hold harmless Sponsor, The Home Depot U.S.A. Inc., Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.
9. Publicity: Except where prohibited, participation in the Sweepstakes constitutes each
winner's consent to Sponsor's, its agents' and/or The Home Depot U.S.A. Inc.'s use of winner's name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
10. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
11. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Sweepstakes, if it is possible. If the Sweepstakes, or any part of it, is discontinued for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
12. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with,
the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.
13. Entrant's Personal Information: Information collected from entrants is subject to Sponsor's Privacy Policy (http://www.citi.com/privacy/us_priv.htm).
14. Winners List: For a winners list, visit http://urlhasbeenblocked/Aa1bt5. The Winners list will be posted after winner confirmation is complete, on or around October 17, 2012.
15. Future Sweepstakes Opt Out: If you would like your name removed from any future sweepstakes mailings by Sponsor, please send your complete name and mailing address to "The Home Depot Commercial Card Ford Truck Sweepstakes Opt Out", PO Box 790340, St. Louis, MO 63179 and your name will be removed within 60 days of the request.
