No federal law governs smoking at work, so workplace smoking laws vary by state. Most states prohibit indoor smoking at work and allow employers to designate smoking areas. Others ban smoking in the workplace all together and a few not at all. In some cases, local laws trump the state with tighter restrictions.
Smokers' Rights Also Vary
States also differ in how they protect smokers' employment rights. According to a Feb. 18, 2010, report by the Voice of America, 29 of the 50 states have laws that protect smokers' rights. The others do not, allowing employers to base employment on an applicant's smoking status.

Second, one of the ways the law got passed initially was based on the fact that there's no way for an employee to opt out of second hand smoke at an establishment and therefor the choice was taken out of their hands, so it's a valid argument.
And third, if you were to bring back smoking at establishments that, say, just opened and they needed to hire people, but it was going to be a smokey environment, then there would most likely be stipulations on who could work there - namely people who don't smoke would be an insurance liability. However, just like you can't ask someone about their personal medical history, you shouldn't be able to ask someone their personal smoking habits.
And as an aside, it would have been an easier argument for me to make that a smoke-full environment is a hostile work environment, and that IS against the law.
