Should I file a lawsuit? do I have a case?

1,730 18 December 7, 2004 at 08:01 AM
Last night my girlfriend opened a can of fancy feast cat fod made by Purina to feed my cats.. upon opening it the the can violently exploded everywhere across her face.. It was the most foul, putrid, rancid contents ever.. It shot out with a great force all over her face and on the ceiling walls, etc.. I have tons of pictures documenting the whole disgusting thing, My girfriend was throwing up for half an hour afterwards and became violently ill.. We both had to throw out all of the clothes we were wearing and my house smells 100 times worse than a garbage dump.. We couldn't stay here last night becuase of the smell.. Now I have all of my windows up and it still smells like shit.. There are also stains all over my walls from the guck.. It was not normal cat food it was a black sludge and the most foul thing you could imagine..

Anyways I called Purina and they said it was a handling issue in their factories and that they improperly handled the can when it was cooking. Do you think a lawyer would take this case? Should we be compensated by Purina? Its the worst thing I've ever seen in my life..

lol.. thats great LMAO .. evidently the can of Salmon Fancy Feast that my girfriend opened had a huge bulge, but my girlfriend didn't know any better as she rarely feeds the cats, but I was sick yesterday and had asked her to do it.. She told me today that she felt so stupid because she noticed the huge bulge before she opened it. Next thing I heard it sounded like a shotgun blast and instant screaming followed by throwup and crying
Well, I thought everyone knew not to open a can of anything that is bulging, but perhaps I learned this during my college days when I worked in a restaurant. A can bulges due to gas build up. As far as botulism, well you did say it was salmon so yes, she should see a doctor if she isnt feeling better. I could be wrong, but I think one can expect to get up to 3 X medical bills in damages. Since the can was bulging, then I would think that the grocery store would hold some blame too. They should have pulled the can, and the clerk should not have sold it to you. I would go back to the store, and see if there is any more like that, photograph them on the self, making sure that you can tell you are in the store, and then purchase them.

You could get a lawyer, but remember that lawyers will take a large lump. Sometimes, you will do better trying to negotiate first yourself. I consider this the tight-ass site. We are all looking for a deal. If the so-called lawyers who have IM you are so successful then why are they visiting the site? I could say Im a lawyer.

My cat is a 21 year old Calico. She lived 19 years on dry Meow Mix. In the last couple of years I had to switched her to wet because she is too old to chew the dry. In those 21 years, she was sick only once. It had been so long ago, but to prevent it from happening again, it was recommended that her (and all cats) food be accessible to her at all times. That is something you cannot do with can cat food.

Wow, 21 years that's awesome. My baby girl will be 16 in March. She had urinary tract infections from the time we got her and had 4 bladder stones removed a few years ago and has been fine since. I leave dry food out all of the time for her and my other cat and at least once a day I give them a little canned food as well.

15k? Oh please!!! You will be lucky to get a year of free cat food. I hate that this happened to your girlfriend but don't you think you are milking the system just a little? As for a lawyer..the best you can get would be an "Ambulance chaser" who will charge you out the arse to accept the case so by the slime chance you do win...you may have 3k to spend. Also If she hasn't been to the E.R. she needs to go....paper trails are everything....Hope everything works out....ps..did your cat every get to eat that night

So how did it finish?

The Companies Big Lawyers played a tremendous game, They manhandled us through a slow grind.. basically they assured us everything would be taken care of and then they slowly let our anger settle down and then they became completely inaccessable and didn't do anything. I did not have the time to waste fighting with them or hiring a lawyer.

I think we got 3 coupons out of the travesty- LMAO

We still buy fancy feast Roll Eyes (Sarcastic) (thats all the cats will eat)

And We got married 3 weeks ago

you mean wife. whether that makes it more or less likely that we'll see any pics is another story.
