I was emailed by an @hearst.com email on Jan 8th at 12:06 pm Pacific saying "congratulations you won the Elie Tahari gift card" it also said to reply with my address and fill out the attached affidavit within 15 days.
I'm posting this from my phone so can't link the contest but its the $1000 Elie Tahari gift card sweep from Elle magazine.
Ok, so, I replied to her congratulations email within 6 hours, at 5:45 pm Pacific on Jan 8th and supplied my address and told her that she must have forgotten to attach the affidavit because there was none attached.
I did not receive a reply so I emailed her again today Jan 10th at 1:31 pm Pacific and asked again about the affidavit. She replied 2 minutes later saying "
Unfortunately there was another winner before you and his email response was received before yours. It is first come first serve. I apologize for the misunderstanding".
Now to me that seems not right and shady. I mean I replied to there initial contact within 6 hours and the email said I had 15 days. Further, I looked at the official rules and in there it says you have 7 days from Initial contact. Any advice? Thanks much.

Look on the bright side, at least it wasn't $10,000 in cash....I had a agency email me they make that error and I wasn't a grand prize winner. I'm still bitter. I think dwelling on these situations is self destructive--but understandably frustrating.

Good thing: The sweepstakes agency still decided to give me my prize and I finally received it...
Confusing thing: I still don't understand what was up with the email system! They supposedly were not getting any emails from me if I was replying to the winning email or if the winning email was a part of my email to them... But they were getting my other emails from the same email address... Totally weird... But it happened, and I still wonder why it happened!

EDIT: replying to your situation... may be something similar happened with you wrt your email not getting delivered... but i believe it is wrong for sweepstakes agency to contact somebody else before your 15-days time-frame to confirm and send the affidavit had passed...

First of all, how can they be so unprofessional that they would e-mail two or who knows how many people that they've won a $1,000 prize when it's for one winner only? I mean, if the first person had 15 days, they should have waited 15 days and not turn this into a rat race by sending multiple notices to see who responds first. I, for one, do not understand how exactly they were able to conduct it this way; especially since it's Hearst. I've won from them and I've never had this happen before, really weird.
Regarding the e-mail reply, I've had that happen a few months ago. I found out because I went on their Facebook site and I saw that they listed the winners, my name, not there. I commented telling them my name isn't listed. The person who was doing the promotion e-mailed me as soon a he saw my comment saying he never received my reply and to forward the e-mail I sent. He said I would still be qualified when he finally received it. I don't entirely know why the first one didn't make it but the second one finally did. I now have to remember that whenever I have to reply to an email, I ask them to respond back confirming delivery of email.
If it was a mistake, then they should just come clean rather than waste your time. I mean it happens, but it's better than giving you the go-around. I could understand if you later read the rules that you're not eligible which happened to me, oops, my fault for not reading, but nowhere does it state that, right?

I wish I could help you, but I've never had a scenario like this before. If nothing, perhaps contact another person higher up or a different department to explain how something like this could have happened. Keep us informed so if anything like this ever happens we know what we could do. Good luck.
