It does not exclude preorders or Sony 1st party games, at least for right now. I just preordered Horizon Forbidden West for PS5 for $39.xx after the discount. This is a great deal.

Just that I knew a couple people it was active and being used for. Placed the order and received an email with the refund notification.

Also, I mentioned I could see the offer but it was greyed out.

He said I wasn't, but made an exception and gave me the discount anyway. It all comes down to luck. He also mentioned it was his daughters birthday and he was excited to end his shift. so I'm pretty sure he was in a very good mood lol. Took me 4 tries before this as most of them just said I'm not eligible.

OK, just had partial success through chat. The rep said that the items weren't eligible, but then offered me the 40% off one item. I got Mario Golf Super Rush for $36. I'll try one or two more times, but I'm happy getting the one game.
