BB sent me a returned unit that had been doctored by the customer: labels peeled off and stuck on a non-working stick of unknown origin.

These units are NOT refurbed, not inspected, not tested. I plugged in the serial number, and Samsung showed it was made 18 months prior. Or, at least, the one the fraud artist has now.

After complaining to corporate, the store was instructed to give me a new one off the shelf. The store "Genius" automatons wouldn't do anything other than telling me to return and reorder. After I waited 3 weeks for the first one.

You don't. Returned items that have been used simply cannot be sold as "new." Then again, BB doesn't even check if they work or are not counterfeit returns.

Bought a 500gb 970 from the prior deal. It had less than 100gb written and only 2 hours of power on time. Obviously luck of the draw but you can always return if abused. Was perfect to upgrade from my 120gb Plextor SSD (retained for backup for now) in my nearly 10 year old pc.
