Funny that you mention this because my friend had this EXACT same problem! We managed to fix it by disassembling the controller and swabbing the microswitch for the RB button with isopropyl alcohol. Way easier to just get an extended warrantee...
I believe their warranty info states they have the option of whatever they want essentially. As I understand it, if they have refurbished on hand that is what you will get. If not then it may be a new one.
My 14yo bought one and it arrives Wednesday and he's pumped, but now I'm starting to get concerned.
They come brand new but somehow the warranty was activated, but you just need to register it through MS, then you can chat them or call them to resolve the initial warranty and add on the extended warranty if you wish.
Update: they honored it but I had to argue a bit.

It was over the phone so it happened pretty quick. I basically just pushed back and told them this is my proof of purchase and can they please accept it, they put me on hold for a few minutes and came back to tell me it was approved
Microsoft Support has been a total nightmare to deal with every time I've had issues.
It is confusing because the page after you enter in all the payment info says congratulations or something of the sort but if you scroll down there is one final button to complete purchase or finalize order or something like that. Once you do that you will get an order number and email.

Yes, the new warranty date is showing online for me. Also was able to add the extended warranty with no issues
