It looks like the fraudulent Fandango is ordered by the court to pay up. If you use Fandango in NY, check your email now. You need your own Unique ID to file a claim. This is legit settlement, but they use epiqnotice.com for redirect which is filled with malware and triggers malicious site warnings. It's ironic that even to get paid, you had to be scammed again by some malicious website. To avoid the scam, go here directly.

This notice is to inform you that a settlement has been reached in a class action lawsuit claiming that Defendant Fandango Media, LLC ("Defendant"), failed to timely disclose a convenience fee for online tickets to movie theaters in New York state, in alleged violation of New York Arts and Cultural Affairs Law ("ACAL") § 25.07(4). Defendant denies that it violated any law, but has agreed to the settlement to avoid the uncertainties and expenses associated with continuing the case.

Am I a Class Member? Our records indicate you may be a Class Member. Class Members are all individuals in the United States who paid a convenience fee to purchase electronic tickets to any movie in any movie theater located within New York state from Fandango's website, mobile phone application, and/or any other Fandango owned or operated online platform from August 29, 2022, to and through March 11, 2024.

What Does The Settlement Provide? If approved by the Court, Defendant will establish a Settlement Benefit Cap of $9,000,000.00. All approved claims submitted by the Settlement Class, together with notice and administration expenses, approved attorneys' fees and costs to Class Counsel, and service awards to the Class Representatives will be subject to the Settlement Benefit Cap. To receive a payment, you must submit a timely and complete Claim Form by mail or online, submitted or postmarked no later than March 31, 2025. You may submit a valid Claim Form by accessing www.FandangoTicketFeeSettlement.com for either (1) a $5.00 cash payment; or (2) a $10.00 voucher for Fandango at Home, at your election. The $10.00 Fandango at Home voucher is a promotional code that can be used to rent or purchase movies or television shows for viewing on the Fandango at Home website or applications. If you elect a cash payment, it will be made by PayPal, Venmo, Zelle, or mailed check, at your election. Claim Forms must be submitted online by 11:59 p.m. EST on www.FandangoTicketFeeSettlement.com or postmarked and mailed to Fandango Ticket Fee Settlement c/o Epiq, PO Box 2833, Portland, OR 97208-2833 by March 31, 2025.

Defendant has also agreed to pay all approved claims to the Settlement Class, together with notice and administrative expenses, approved attorneys' fees and costs to Class Counsel, and service awards to the Class Representatives. Additionally, Defendant has changed the purchase flow for tickets to New York theatres on its website and agrees to comply with ACAL § 25.07(4) unless and until it is amended, repealed, or otherwise invalidated.

What are My Other Options? You may exclude yourself from the Class by sending a letter to the settlement administrator no later than January 28, 2025. If you exclude yourself, you cannot get a settlement benefit, but you keep any rights you may have to sue the Defendant over the legal issues in the lawsuit. You and/or your lawyer have the right to appear before the Court and/or object to the proposed settlement. Your written objection must be filed no later than January 28, 2025. Specific instructions about how to object to or exclude yourself from the Settlement are available at www.FandangoTicketFeeSettlement.com. If you file a claim or do nothing, and the Court approves the Settlement, you will be bound by all of the Court's orders and judgments. In addition, any claims relating to convenience fees in connection with electronic ticket sales on Fandango's website, mobile phone application, and/or any online platform owned or operated by or on behalf of Defendant from August 29, 2022 through and including March 11, 2024, will be released.

Who Represents Me? The Court has appointed lawyers Philip L. Fraietta and Stefan Bogdanovich of Bursor & Fisher, P.A. to represent the class. These attorneys are called Class Counsel. You will not be charged for these lawyers. If you want to be represented by your own lawyer in this case, you may hire one at your expense.

When Will the Court Consider the Proposed Settlement? The Court will hold the Final Approval Hearing at 9:00 a.m. on February 27, 2025, IAS Part 30 at the Supreme Court of the State of New York, County of Nassau, 100 Supreme Court Drive, Mineola, New York 11501. At that hearing, the Court will: hear any objections concerning the fairness of the settlement; determine the fairness of the settlement; decide whether to approve Class Counsel's request for attorneys' fees and costs; and decide whether to award Class Representatives Clair Awad and Shane Mannion $5,000 each for their service in helping to bring and settle this case. Defendant has agreed to pay Class Counsel reasonable attorneys' fees in an amount to be determined by the Court. Class Counsel may seek no more than $2,250,000, but the Court may award less than this amount.

So why is this important to mention? Because I now know for a fact that I did not miss any notification emails since I do not meet the qualifications to receive the notification that I have a case ID etc...
I see you are into posting as much info as you can, So I hope you appreciate this tip to include that paragraph at the beginning of the OP with an edit.

Thanks, I made the modifications. You need the UniqueID anyway to file the claim, and you get one only if you ordered tickets in NY in the past. I posted it quickly because my point was to tell people it's not a scam. I figured some people might ignore their email because when they click the redirect link sent by Fandango, it goes thru epiqnotice.com which will trigger all kinds of warning from anti-virus software. Then people would think it's a scam.
