$9.90 with 15% S&S...not bad.

Amazon is charging tax in NYS though. I thought food items like this shouldn't be taxed?

Amazon is really weird and inconsistent with taxing food in NYS. I've had certain flavors of protein bars taxed (like peanut butter) but not others. Customer service never had a good answer, just saying they are complying with NYS laws...Confused

Fast food is also food but it surely taxed. What ai think "raw" food items such as anything natural like kale, broccoli, apple and such are not taxed and considered "food" that's a *necessity* in life.

While food such as fast food are enhanced, prepared, or processed for you and for your taste buds. So such food is not a necessity for life but a luxury to indulge on. So they want you to pay tax for the "luxury" as you would do for a hotel which is not a necessity to live in. So, similar logic is being used here with this enhanced snack.

So I looked up the NYS law on this finally and they have a specific call out for "coated nuts" but apply them to candy/chocolate coated. Wasabi and soy sauce coated does not explicitly fall under this definition but Amazon may be applying it due to a unified product listing.

Also by your definition, any processed or enhanced snack would be taxable like cookies, Cheez-Its, pudding, or sugary cereals. But they're not...NY applies the tax exemption on food pretty liberally and most are exempted as long as it's not a fruit drink, soda, candy/chocolate, or a coated nut.

So the general logic is the same as I stated. It is just the eye of the beholder (the torchbearers of the law) who may have different opinioj on certain processed/prepared food such as cereal and that such items as cereal should fall under "necessity" food. Regardless, the logic is being used sparingly and there is gray areas. Milk is not taxable, nor yogurt which is arguably a processed/prepared food items. So, basically the real life situation is not that black and white, so we just need to see each item and figure as if it is a natural or "necessity" food item. Interestingly, raw almond on Amazon are also being taxed which I am questioning the validity of tax on that
