Going to repost my other review for these here as well.

These are awful headphones overall. They sound good but are unreliable, uncomfortable, and barely stay on your head.

Bought these over the summer and they're just not worth it. The sound is decent and even the noise cancelling isn't bad, but every other aspect sucks.

The touch controls are way too sensitive to the point where when my arms go above my head there's a decent chance my shoulder is going to touch the pad and it'll detect some gesture. They randomly turn on when I have them in my bag. Even when trying to turn them off, sometimes they'll turn right back on. They really struggle with 2 connections. Of course any headphone has issues if you try to listen to 2 sources at once. That's not the issue. I mean to say, if 2 devices are connected and one is playing music and the other is not doing anything, sometimes they'll favor the idle device. They'll randomly try to connect to old devices; leading you to basically need to re-pair every time you want to use them. They fall of your ears/head way easier than any other pair I've owned. The touch gestures sometimes just don't work. And the most annoying this is the distance. My old sennheisers could probably handle 30-40 ft no problem and still had crystal clear audio. These start to degrade audio quality after more than 15 feet away.

I could go on but they're just a bad experience. I'd highly recommend getting anything else in the same price bracket.

May I suggest the Bowers & Wilkins PX7 S2 for $200 or less as the higher quality alternative. These are entry level audiophile grade, with stellar build quality to match. Only weak spot is the noice canceling vs other consumer headphones. Costco had them on clearance for $150 - perhaps the headphone bargain of the decade - but you won't find anything under $500 that beats them, so $200 is still great price.

If NC is important, the Sony 1000XM4 is the best option and may be found refurbished or open box from $110 via Secondipity or their eBay store.

Avoid the Sony 1000xm5 because the hinges break from normal/light use - the build quality of recycled trash bags. There is a whole Reddit community on this single issue Lol

Had mine for about year. Love the battery life and audio quality. I had no issue on touch control and connecting to more than one devices. Way better than xm3 I had before. Paid $150 when it was sale. I would've not bought it if it was $200 or more(alot of better choices above $200). Btw make sure to update firmware using their app.

I think you might've gotten a one off product. I've tried these and they had the best sound quality I've ever had. Sure the ANC and Comfort weren't good as something like the Quietcomfort ultra or XM6, but at least for me, that's not why im buying headphones as I only use them at home and not on the go.
as for the other issues you've mentioned, I've never had those, but I understand that there can be faulty devices every once in a while. You might've gotten unlucky with your headphones
