The legal limit for an ebike tops out at 28mph and 750W (1hp). Anything above either speed or power is a moped or a motorcycle, both of which require licenses.

Some states limit kids even more, like to ebikes capped at 20mph. NJ has banned ebikes for all unlicensed riders, after a kid ebiked into traffic and died. (And all parties voted for it. "Think of the children!")

Furthermore, this form factor is not good for a bicycle where you pedal. That big, wide seat? Yeah, that's crap for pedaling. Do you see any way of adjusting that seat for pedal comfort or power? Absolutely not. Notice how slack the chain is in the "action shot" on level ground. Not a great sign for keeping the chain attached.

Lastly, this "bike" screams "I wish I were a motorcycle." Triple-tree front end? Way too heavy for any bicycle. Oversized tubular steel frame? Same. Square seat in a fixed position? Only for 100% motor use. Big ol' eyeball headlight? Absolutely motorcycle-wannabe.

This thing all but has a sign that says "Do any cops want to harass me over my unlicensed e-motorcycle?"

There are waay too many laws to name as they vary from state to state and even city to city.

Here is one of the most comprehensive article I have found.. that is even made by an ebike company.
https://www.velotricbike.com/blog...s-by-state

I am a USAF veteran living in Montana, and our outdated laws have ebikes capped at 20MPH, Mopeds at 28mph , and the rest are required to be certified as an electric motorbike.
You are required to have a driver's license to drive a moped in MT (so some older middle schoolers may be able to drive a moped). And a motorcycle endorsement for an emotorcycle.

Here straight from the state:

Typically the law that limits mopeds to 1bhp (750W) and/or 30mph. Everything faster/more powerful is a motorcycle. You know many states that license middle schoolers for motorcycles? For the states I've bothered looking up ( California, Indiana, Kentucky, New York, New Jersey, Missouri & Michigan) it is a motorized vehicle that requires registration, plates, driver's license, etc. But that assumes it has a VIN and even can be registered, which it doesn't, so it is an "offroad-only" motorcycle which cannot be used on public roads.I found a few links in my search historyThe state of Washington, which limits ebikes to a max of 750W and speeds under 28mph for class 3. Class 1 & 2 are capped at 750W & 20mph.https://wsdot.wa.gov/travel/bicyc...aws-safetyIf this were a moped you would need a motorcycle drivers license to operate it except this is not a moped in Washington as they are limited to 2hp (1500W) and 30mph, sp 40mph is right out.https://app.leg.wa.gov/rcw/defaul...=46.04.304So this is a motorcycle in Washington, which requires license, registration, plates, insurancw, etc. But it won't be street legal by default so you can't get those things. To make it street legal go through this processhttps://dol.wa.gov/vehicles-and-b...otorcyclesNote that all lamps, hydraulics and tires must have appropriate DOT certifications to be road legal for the inspection to pass.Next state: New Jersey. ALL e-bikes in New Jersey will require the rider to be 15+ and have a license. Plus any ebike that goes over 20mph needs an insurance policy (that doesn't exist). But the kicker is that it also makes online advertisements or sales of any 2-wheel motorized device that can do more than 28mph illegal for at least 12 months.https://www.bicycleretailer.com/i...nce-e-bike
It's neither a moped nor a motorcycle, regardless of speed, if there's no vin....

I was just looking in to getting an ebike here in MI. Nothing I looked at fits into the classes. The mountain bike style I wanted couldn't be ridden anywhere but on the street from what I can figure. I'm so glad we have these laws, for our safety.
At a certain speed, its a motorcycle. Just buy a street legal motorcycle with headlights, blinkers, and brakes that will stop you. New, street legal 250cc bikes can be found for under $4k. You could try to buy a cheaper 150cc dirt bike and have it upgraded with lights and such to be street legal but it'd be easier to just buy something street legal from the get go.

And if you want a street legal mountain bike that can haul you anywhere, you just need torque. There are plenty of <750W mid-drive e-mtbs with a ton of hill-climbing torque in class1/2/3.

Will they cost you close to $3k? Yes, yes they will. But look at the Aventon Ramblas with 100Nm of torque, which is almost 3x the torque of a Triump speed 400 (40hp, 38Nm). It will help you go up mountains like a goat and you can ride it home on the streets.

My state, it's still an e-bike.
What state? I'm pretty sure the statutes are online for what qualifies as a bicycle vs e-bike vs motorcycle.

Take a walmart bicycle and stick a 50cc motor in it. No VIN but its clearly a moped. Put in a 250cc motor. Now its a motorcycle.

Is it registerable? That's a different question. Many states do have processes for making a vin-less cycle street legal so people can build a motorcycle from the ground up.

Just because a manufacturer doesn't go through the effort of making it a registerable vehicle doesn't change what type of vehicle it is.

I have this exact bike, bought last year and have put about 120 miles into it. Would not recommend for under 16 years of age - as someone who is 150lb, these hit 29 mph easily, are heavy, and the brakes aren't quite the best. But, it is a lot of fun!

I live in a major city, and will only ride this on the street, and some bike lanes if I go slow enough. It's a wide bike, and zooming past actual bikers is a douche thing to do at full speed (I also say this as someone who bikes a lot).

Note though, Megawheels is a company that pays for reviews - so take them with a grain of salt.

Good answer. Yes, it's up to every jurisdiction to create their own ordinance (what it's called in my jurisdiction). Most don't. Thus, the question. My state has 0 legislation for anything above 750. My city is the same, as are most. Again, it's why I asked the question...And doubt me all you want. But kind of a weird user name if I wasn't?
Username allows you to be anybody, anyway, anything, from anywhere, so factual based proof of a username is basically only a crapshoot for an attempt at a reality-based reality.

Not surprised that a cop doesn't use common sense. Something that goes 33mph and the damage it can cause to the rider (or others/property) should be obvious, especially in the hands of middle school aged child. If you need that to be put in an official code for it to make sense, there's bigger issues at hand. Roll Eyes (Sarcastic)
I think cops have more important things to do than protect middle schoolers from their own parents poor decisions.
I see people riding bikes the wrong way (against traffic) all the time, and I've never seen a cop do a thing about it.

huh ??.....I never said they didn't.

He literally interjected himself into the conversation and stated he was a cop. Regardless, what you wrote has nothing to do with what I wrote about using common sense, no matter the profession.

So what exactly do you want him to do? Is this your first time on the internet???

Do you always have trouble following even basic conversations on the internet ??

It did not start as me saying randomly: "Hey I wish more cops would stop middle schoolers on these ! "

It was him (for some reason saying he was a cop), wondering what "code" (which it wouldn't be a code in any case) from stopping kids from riding these to another person's reply.

I said basically common sense should tell you (code or not) a 33 mph motorized vehicle for a small kid, probably isn't a good idea if you want them to stay in one piece.

Let me know if I need to bring out your crayons if you're still confused.

Obviously you are the one having trouble here.
Here's what the cop originally said:
"Cop for 29 years. What's the code that makes it illegal for middle schooler's in your jurisdiction?"
According to you, it wouldn't be a "code." Why wouldn't it be a code? You clearly have no clue what you are talking about.
I honestly don't have the energy to help you understand this simple thread. Maybe someone else can help you, or you can just slowly re-read it from the beginning. I just don't care. Sorry.
