If an advertisement brings you in only to find out it's not what was advertised, that's bait and switch. You click on the website thinking you are getting 40% off, but then when you are there, you realize that you are not getting 40% off. Sure, it's a different kind of interpretation but technically it's the same end result. They get you in the door under false pretense and even if you realize that it's false, they already got you in the door.
According to other people, they have jacked up the regular prices. Be careful.

It's called "false reference pricing" when the seller advertises a percentage off sale but at the same time increases the pre-discount price. It's my understanding false reference pricing is reportable to and treated as fraud by the Federal Trade Commission. Some states also make it explicitly illegal by statute and will impose heavy fines where appropriate.
