Macy's is running a background check on my 6 year old child, is that legal?

So this past christmas my 6 year old was hurt at macy's when a display shelf came crashing down.

Today is the 1st time they contacted me.

The wanted to know about a car accident we had 3 months ago.

How the hell do they know my 6 year old was in a car accident unless they ran a background check.

Any ideas?

And no trolls, I'm not looking for legal advice, I'm looking for the database that Macy's used to check on my child.

OP, what do you think happens to all of these accident reports you file? Surely they can't be aggregated into a database that protects its clients from frivolous claims by individuals that repeatedly file the same claims with multiple corporations, right?

If the kid fell down then got back up, probably not. If a big fuss was made over it, then yes most likely. Even if they refused to give information, the manager probably still would have filed a claim to acknowledge the event and their refusal to co-operate so if they came back with a lawsuit, they would have record of it.

OP, with all due respect, you kind of sound like a dirtbag with all these claims to the point where even when something legit comes along, it seems like you're crying wolf. That said, you do have legal options. If you plan to go through with the claim, get a lawyer, and stop answering questions from ANYONE. Let the lawyer handle it and refer all inquiries to them.

I think the OP is abusing his kid and intentionally making him fall to get money out of the big corporations. child abuse!

Because a kid fell down? I can understand if there was an injury or an open wound, but most fast food joints wouldn't even notice if a kid fell down.

In OP's defense, he's hardly a 'dirtbag' yet IMO. Kid injured himself at Macy's. Kid injured himself at McDonald's. Okay, it's happened twice. It's not that unbelievable.

Unless it's happened 3 more times.

After your information is run through the claims database and multiple similar hits come up, it's just a matter of $20 or so to run a background check on you and get your MVR, criminal record, civil record, etc.

Yea b ut you can read between the lines here. The kid fell down at McDonalds, he didn't "injure himself". And OP noted that he "let it go", as though he's some saint that chose not to take action because his kid fell down. That's what you're SUPPOSED to do. You didn't let anything go, there was nothing to let go. Your kid fell down, he got up and he was fine. What the hell was there to let go? Someone's kid should fall on his property and sue and we'll see what he'll say then.

People still give their information. This helps to protect them in case any issue comes from the incident. The manager would be strongly encouraged to get the information for the form.

When I was a kid I fell on metal stairs at a Burger King playground and cut my gums really bad. I had to be taken to the ER and almost had to get stitches but it was just below the minimum depth for them. We never filed a claim at BK or tried to even get the medical bills paid for. Amazing how times have changed now where any little accident turns into litigation.

I've seen stuff like this before though. The kid falls because of something, some spilt ice, water etc and starts screaming and crying (like most 1-7 year olds do when they fall, slip, bump their head etc). The parents probably said something like "OMG where is the WET FLOOR sign?" and started a scene by speaking loudly, rolling eyes, etc. Kid still crying.... you get the picture.
