Not Sure What To Do

OK, okay, I won't post any more threads in the lounge for a while after this, I promise. Embarrassment

Between my dad's recent hospitalization and other things, I have had a lot of stressful situations going on in my life lately.

Recently, I went over to a friend's (Friend2) house for a little get together and left my DS lite with a few games and other things (totaling approximately $150) because my friend (Friend1) requested that I do so. This friend (Friend1) then left the house, forgetting the DS Lite and all along with a backpack full of my sleep-over necessities (toothbrush, shampoo, etc.) at my other friend's (Friend2) house.

After two weeks of texting Friend2, so many excuses have been made as to why I can't go over and get the DS. I wouldn't doubt by now he sold it to some crack head for $5.

What can I do in this situation? Friend1 is like a brother to me.

OP,
Legally speaking, Friend1 would be on the hook for your items. You left them in Friend1's custody. So, it's his/her responsibility. It would only be Friend2's responsibility if you can prove that Friend2 stole the items. The mere fact that those items were at Friend2's house doesn't prove it either. You would need to show proof that Friend2 had the items and sold them (or still has them in his/her possession).

Because, Friend2 could easily state that someone else (even Friend1) stole the items. And, you couldn't prove otherwise.

Friend2 has stated (somewhat indirectly now that I think about it) in a text message that the items are at his house and therefore in his possession.

Sorry had to edit what I said. He wasn't 100% direct about saying the DS was at his house. Just that when I asked him about it he said he would get it back to me.

Call the local police station. Tell them this person has possession of your items and refuses to return them. See if you can get a police escort to the persons home and have the officer ask for the return of your items. It's worth a shot...

Unfortunately, I think most police depts will say it's a civil matter. It's really not "theft" since Friend1 forgot the items at Friend2's house.
