Am I being unreasonable or wrong in this Craigslist dispute?

Hi folks,

I will keep the story short but sufficient in quickly helping you understand the situation.

I sold a merchandise to a person on Craigslist for $130 dollars. This person was unable to pay the complete $130 at the time and offered to pay in two payments and told me that he was good for it. I initially declined this idea, not being comfortable with it. He later offered to "give up" a piece of electronic as collateral as something for me to hold on to. This was a Playstation 3 Slim. The first payment which I accepted was then $80 alongside the PS3.

He said he would be able to pay the remaining $50 the next weekend. The first meet-up was on a weekend, so it was essentially a week in-between the two original proposed payment times. However, at that time, I was going on a holiday and got stuck at the airport. As such, I couldn't make that weekend and asked if he could do the day after.

The first transaction was made on July 1st, meaning that the second payment was supposed to be on July 8th to 10th?

Since then, he has either been out of town or has repeatedly told me that he does not have the money on dates which he himself set up as dates of payments (3 or more times now). I have also found out that the merchandise which I sold him (a phone), is now broken.

I recently (i.e., mid September) -subtly indicated- to him that I cannot be waiting forever to get my money back and that at some point, I would take the PS3 as collateral. He proposed an October 1st payment as a date where he "should be" able to make the payment.

Based on e-mail exchanges in the past 48 hours, it is evident that he cannot make that date again, to which I provided an ultimatum for an additional one-more week extension.
Should he miss this date, I will terminate the deal and consider the PS3 to be collateral.

He is now flipping out, and mentioning that he couldn't believe that I was like this. He stated that he would be forced to call a lawyer should it come to that. He also indicated that he is only getting paid at the end of October and can only pay "then". He says he doesn't know what else he can do but again reiterated that he would be forced to contact a lawyer should it come down to that.

I haven't responded yet, but I'm looking for thoughts and ideas here. Am I being unreasonable? I'm only asking for my $50 back and it's close to 3 months now.

OP,
Sorry but why would you think this is all resolved now? He hasn't actually paid you yet! All he said was that he'd have the money on Fri or Sun. After all you've been through with him, do you actually have that much faith in him that he'll follow through? I'm not saying that he won't have it for sure by Sunday. But, you sure seem certain that all your troubles are behind you.

When in actuality, nothing has been resolved yet. As far as the continued lawyer talk, that's ridiculous. As others have stated, how can he get a lawyer when he can't even afford to pay you back $50?!?!? Seriously, how old are you?

I'm not about to read over the entire thread since I last posted, but as a paralegal and former Criminal Justice student, I can't even begin to imagine what law you'd be breaking by selling an item given to you as collateral. Good luck w/ this idiot anyway.

OP, don't reply to this guy's emails unless he wants to meet you to pay the money he owes you.
Wait until the 9th, if you don't hear from him by then don't email him, that's the end of the story, period.

Nah, it's behind me in the sense that at least I got some sort of message from him. This way, I know that he is fully aware of the ultimatum I sent him a week back. This way, if he has it or not, it won't matter to me any further. Once the date passes, I'm pretty much done with this person.

I'm personally skeptical if he can actually get the $50 or if he just replied to me to try and jerk or scare me into returning the PS3 either way which obviously isn't working.

What he might do is he'll tell you that he has the $50 and to meet him on Fri or Sun. When you show up, he won't have the $50 and he will *demand* his PS3 back. Otherwise he will go to his lawyer.

I actually think this is a great idea except like Scampsters and Z2g mentioned, he could claim it was broken. In any case, the whole situation should have been avoided from the start.

Take a picture of you holding it over a tub full of water with a ransom note taped to it and send him the pic. Also, just to piss him off even more, call his bluff on a lawyer and tell him he's full of crap. If he doesn't deliver on his promise to pay throw it in some water, break it up into pieces, and give it back to him... I think that'd be $50 worth of satisfaction nod

I hope this guy is 10-12 year old....if you can't come up with $50 bucks you might as well kill yourself.....and what kind of a retard would put a 200+ console as a collateral. People are so stupid!

You can either forget about the $50 or not, doesn't matter. You can sell the PS3 for more than $50 if you want. Smilie
