First car accident... need advice

This Saturday I was in an accident that destroyed my Scion XD. I LOVED that car. Was getting about 35MPG in the city and I gad done a BUNCH of upgrades to it. Only 24K miles on it.

Here's what happened:

I was driving through a main road on my way home from work when I 17 year old kid decided to turn right in front of me in a Caravan. It wasn't at an intersection, he was trying to turn into a business from his yellow lane and I guess he didn't see me coming, so I slammed into him a 40MPH. He got cited, I didn't and it obviously was his fault since he should have waited for me to come through. Oh well, there goes my car.......

Few questions:

Now that I submitted the claim through his insurance, they told I need to simply wait since the other driver has not given a statement yet. No rental car. Is this normal? They mentioned that the other person needs to admit liability first.

Also, by what guidelines can I expect my compensation to be for my car? I know insurances have their own 'sources', but I don't want to be screwed. My car was at [I]least[I] worth 14K and it's paid off. Also, I should be compensated for my 2 days off work and medical bills, right?

I never been in a car accident.... so I don't know what my next steps would be.

You go into the middle of PA, and get into an accident and have to sue, and you'll be awarded a lot, same with the major two cities on each end of PA, Philly & Pitt. It's the suburbs, and certain Counties within them, where they have cracked down on large awards for certain types of injuries. You dread getting hit in Philly as probably 50% of the people do not have insurance to begin with, yet you would get a better award there and/or the person would leave the scene of the accident before a cop would ever show up. That happened to my BIL, when a woman hit him, claimed responsibility for it; and before he could even get all her information she took off, before a cop even got there. He ended up claiming it on his insurance Mad It's such a gamble in PA with insurance and driving Ranting

Nope, we have my FIL's vehicle as an "extra" since he no longer is able to drive, we are able to use that, since we are the driver's on it. If we didn't have that, we would have kept our Cadillac, which we recently sold. We have always had a spare vehicle, just in case laugh out loud

Though there have been times customer cars have been brought home for me to drive for a month or longer, to find out what the problem was they were having. One in particular was a Benz S Class, and it was a beauty, and it was hard to give that back LMAO

Oh, I would take the Audi over the Corvette - Corvette's ride like crap, honestly, I've driven them vs an Audi - and an Audi rides much smoother and you don't have to worry about bumps, dips, and whatever when driving an Audi vs a Corvette being so low to the ground bulb

That car was a real head turner, freaking head rests in the back went down with a touch of a button, the sun curtain for the rear window did the same, the side view mirrors, with a touch of a button, would pull all the way in toward the car - came in handy went I went through the old 1-1/2 car tunnels we have around here from yesteryear - and didn't have to worry about those mirrors on that vehicle. It had so many kewl things on it - it killed me when hubby said it had to go back - that we had worked out all the kinks in it Sadwalk

It really is amazing what kind of features they can put in a car now. I was just completely in awe when I was car shopping. I'm totally in LOVE with the features I have in my new car. And it's just little, things too! Like the blindspot mirrors in the corners of each of the sideview mirrors. The capless gas tank. (WHY did it take us so many decades to come up with those two things? laugh out loud) All the voice-activated features, the seat warmers, the de-icing in all the glass and mirrors, the cell phone syncing, the list goes on and on.

I can only imagine what kind of features cars will have a decade or two from now! Probably won't have buttons at all anymore! laugh out loud

Ermm They rented one of my co-workers an Audi a few years back when he came out on a trip. The thing had a horrible ride. It made freshly paved, smooth roads feel like dirt roads!

I would buy a Car DVR to be put it in the car (point to the front). I would turn it on whenever driving the vehicle. It will help you when you file claim on this case since it will record the incident. You can get one easily from Ebay for around $30. You will need a SD memory card around $10 for 4GB. It will be good for 2 hours with self looping (VGA mode, always keep last 2 hours of recording). nod

Yep, my Lincoln has seat warmers, hubby put them in for me, any vehicle just about can have them installed after it comes out of the factory; also has de-icing on the side view mirrors which is great for the winter time up here (as they are heated - but when one goes bad they are expensive to replace cha-ching) and they change shades of color as well; all the buttons I need are on my steering wheel for me to control things - I don't have to reach to my dashboard for many things. Even though it's an older vehicle, they still managed to get a lot of the things correct back then. The newer vehicles are totally awesome as you are saying with everything in them; but we'll tell you from a repair stand point, they are a nightmare and expensive to fix electronically when they break down. That is why we always find something older ourselves **hint** The more they put in them, the more it costs for repairs, as everything is computer based, with "computer brains" and that means reprogramming when things go wrong, and that gets mighty expensive. Plus, the diagnostic end of it; finding the problem as well. Then people bioatch about Technicians and why it costs so much - look at all you listed above laugh out loud

Well, me taking a Corvette over numerous speed bumps they have around here in the Shopping Centers vs an Audi - I'll take the Audi thanks - cause I don't want to be the one responsible for undercarriage damage - due to the unbelievable amount of speed bumps Roll Eyes (Sarcastic) Plus, having driven Corvette's - I'll still say they drive like crap compared to an Audi for regular driving. I don't think there aren't many vehicles I haven't driven, except maybe a Lamborghini or a Ferrari yet, maybe someday Whee

So be careful here with the Attorney - and make sure you do not "hound" them to death over this. FYI - been there done it, and I know that backing off and letting them alone sometimes is in your best interest - the wheels of justice turn slowly - plus any Attorney that handles these types of cases is probably handling around 150 or more of these cases at one time - and where are you in that line? How much is your case "worth" - depends on how quickly they work on your particular case - as to the value of your case - just letting you know this.

Though since you were unable to move it forward any other way - good for you woot

I am actually glad that things are in the lawyer's hands. This was a lawyer recommended by a very good co-worker who used him before and got great results. the lawyer mentioned that they will first get me compensation for my car, in which like you mentioned, they get no money from. THAT I will make sure that they get me as much as possible, as that is my MAIN concern.

As to the medical: If at the end of everything they payoff everything and I only get $1, I am happy. I am not trying to 'make' money off the insurance. I just want what is fair: the value of my car.

I will keep you all updated! Thanks for everything!

Btw, I just went to the Chiropractor today. He wants me in three times a week.
