That is my thoughts on the whole case. But then again I hate apple with a passion. But that's just me.

I would allow you to patent the material for the suit, but not the suit its self. Maybe the specific colors and design of the suit as well if it were particular enough (not "My suit has two leg ports, two arm ports, and an opening for a head type appendage").
Given that analogy, I would allow apple to patent the mechanics of how it got the computer to recognize the gesturing, but I would not allow patenting of the entire idea of gestures. Then I would also allow others to patent their specific ways of getting the computer to do what they want it to, but then allow others to come up with other, possibly better, ways to do the same on their systems.

Apple's claim that they look the same is based on the App drawer, not the homescreen UI
Yes any of the app drawers would look similar to ios's home screen, BUT ITS NOT THE HOMESCREEN
thats the main argument i have against apple, if you turn on a S3, you don't see that app drawer until you hit the app drawer button
you turn on any iphone, you see the tiles.
