i understand where you are coming from and i partially agree, but apple developed a way of getting the device to understand whats happening with multitouch.. in superman they depict superman as being able to deflect bullets, but that doesnt mean that you shouldnt be able to patent a highly effective bullet proof spandex suit.....

there are ways to inovate and not copy, which is what microsoft is doing with their Slate:

I partially agree, but counter:

I would allow you to patent the material for the suit, but not the suit its self. Maybe the specific colors and design of the suit as well if it were particular enough (not "My suit has two leg ports, two arm ports, and an opening for a head type appendage").

Given that analogy, I would allow apple to patent the mechanics of how it got the computer to recognize the gesturing, but I would not allow patenting of the entire idea of gestures. Then I would also allow others to patent their specific ways of getting the computer to do what they want it to, but then allow others to come up with other, possibly better, ways to do the same on their systems.

to me its one of these things where there is no right answer....

we make too many laws and rules about what people/companies can and cant do

then people get all f-ed up by all the loopholes and red tape

then we remove the rules

then we get screwed by people who take advantage....

or hell, maybe that is just human nature.

You gotta remember what Android is... It is behind the scenes. Everything you see, everything that is front facing is not Android but the skin the company puts on it. Samsung has their look, HTC has their look, and Moto has their look.

That is why Apple was after Samsung and not Android for the software bits.

I knew they were going to win this suit in the US. Just as Samsung obviously would win in Korea. The thing is Apple has lost this suit in a few courts in Europe already and predicted to either lose or be thrown out of the ongoing ones.

So if numerous courts around the world continue to tell Apple they are being ridiculous. What does say about the legitimacy of Apple's claims?

actually apple went after samsung because they were surpassing them in the market.

HTC is barely staying afloat right now, and in the last year or so they've been crashing/burning.

Moto's been basically on the verge of bankruptcy before google bought them last year.

LG wasn't a major player in the smartphone market until this year.

And the #1 thing that apple says samsung stole the UI, i got news for you

Apple's claim that they look the same is based on the App drawer, not the homescreen UI
Yes any of the app drawers would look similar to ios's home screen, BUT ITS NOT THE HOMESCREEN

thats the main argument i have against apple, if you turn on a S3, you don't see that app drawer until you hit the app drawer button

you turn on any iphone, you see the tiles.
