That's not entirely accurate. Nowadays it's more common, so going forward it will hopefully be the case that you can rely on 4K discs coming with 4K codes. But there are plenty of examples of 4K discs that came with HD codes: the initial 4K release of Star Trek, The Great Gatsby, the initial 4K release of King Kong, just to name a few.
