Can a student claim tuition fees without a source of income (parent paid) filed as an individual and not dependent on parents return?

You're asking if you had qualified tuition expenses for a year, but your parents directly paid the school, if you can claim those credits yourself? The answer is yes. You will receive a 1098-T form from your school. That form will list your education expenses regardless of who paid them. If you file taxes independently then you can take the tax credit.

Keep in mind that only $1k of the american opportunity tax credit is refundable. So if you made no income that year you can only get 1k back. Someone with income who pays net taxes in a year can get up to $2500 of those taxes refunded.

Thank you for a quick response. Parent's gross income is $95K and AOTC is not applicable. He had small part-time income from W2 about $6,000. I have two options: Parent can file as dependent in which case less tax refund $1,000; 2) file independently get abut $1,000 more tax refund (tuition fee is about $31K). Not sure which way to go?
