Apparently a reseller but use the ebay code countdown22 bring it down below the msrp, so I still decide to share it.

I wouldn't say doesn't have a warranty, Nintendo can usually give you the warranty date, just say console was a gift, I've never had to send in a receipt for repairs with Nintendo under-warranty repairs.

Just received mine, I had previously sent them a message right before I ordered to ask them if it was a US system. They got back within a few hours and said yes it was a US system but when I got it today it was a Japanese one Frown Game was US though

Sounds like you bought the wrong listing. Seller has another listing that is the console only without the game. I just clicked on the link and the bundle still comes up with the game included.

I did not see anything regarding region on the warranty page so I called:

1-800-255-3700 option 1,2,2,1,3,3

Will Nintendo warranty the Japanese console in the North American region?
"Yes, the region does not matter since the console is not region locked. In the event of a warranty Nintendo will replace the console with a North American version."

Does the vendor matter?
"No, as long as you can prove the purchase date with a valid receipt."

I received a Japanese console as well. Complete waste of my timeā€¦

On top of it, the items were thrown in a priority mail box without any packing material. The boxes of the items were damaged.

I purchased via the link here. It's very confusing, the title listing says game included but description says game not included. About to return it.

Not sure what's happening on your side (mobile?) but when I access the Slickdeals link, the listing shows that the game's included. I just received my shipment today and I received the console and the game.

I would contact the seller ... they seem to be fairly responsive. If you paid the 359+tax price, I don't think they'll mind shipping the game out.

That is specifically talking about the game not being included with the system itself, which is technically correct. Scrolling down through the rest of the description clearly states that the game is included with the bundle and talks about the features of the game itself:
