Legality. Probably doesn't have enough sugar or something that coins the name candy. Much like how Pringles CAN NOT be called a potato chip (I believe not enough potato in the final product). Call it a Potato Snack and it is ok.

Your claims sparked my curiosity so I gandered the ingredient list. The most "harmful, poisonous" thing in them is likely the coloring. You'd probably have to consume an obscene amount of these for it to be an issue—too much sugar would probably be the detrimental factor before food coloring. Anyway, am by no means claiming these are a healthy food in any shape or form, but your warning is certainly more FUD than anything.
