Can't use as anti theft tracker.
Apple has the ability to use these and iPhones to help recover stolen goods etc.
However, they instead send notifications to criminals if they are transporting said equipment and goods. I understand these were being used nefariously by stockers. They don't assist Police or owner any data to help with recovery.
Also very annoying as if you want to use one to track a child. Anyone that is in vicinity of your child will continually get notified there is a Apple tag. Example Bus ride 10 people keep getting notifications from Apple.
Could be so useful. Apple honestly turned the device into a barely useful tool.
The AirTag 2 will have a longer tracking range than the original AirTag. This is due to the inclusion of a second-generation Ultra Wideband chip, which has three times the range of the original chip.

All Apple did was set it so that if it's in close proximity for hours with someone then they'll get an alert. There is no magic ability that can enable an electronic device to know whether its being used legitimately (or legally). From my usage I think the line that was drawn is fair.
