BIC® SOLEIL® "100 DAYS OF SUNNY MOMENTS" PROMOTION OFFICIAL RULES



NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. PROMOTION IS OPEN TO RESIDENTS CURRENTLY RESIDING IN THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AT THE TIME OF ENTRY.

1. TO ENTER: Go to www.FeelTheSoleil.com, click on the "USA" button and then click on the "BIC® SOLEIL® 100 Days of Sunny Moments Promotion" button between 12:00:01 a.m. (ET) on May 1, 2011 and 11:59:59 p.m. (ET) on August 8, 2011 ("Promotion Period") and fill in your name, address (no post office boxes, only street or rural route addresses), city, state, zip code, phone number, e-mail address, date of birth and create a password in the online registration fields. All online entries must be submitted and received by 11:59:59 p.m. (ET) August 8, 2011. No mass entries or mechanically reproduced entries will be accepted.

2. ENTRIES: Planned Sunny Moments (Daily Prize): During the Promotion Period, there will be one (1) Planned Sunny Moment per day from May 1, 2011 - August 8, 2011, where you will be able to enter into the prize drawing. You may choose to enter/participate in that particular day's Planned Sunny Moment or not. Each Planned Sunny Moment will last four (4) hours and take place from 1:00:00 p.m. (ET) - 5:00:00 p.m. (ET) every day. Planned Sunny Moments will be featured on the homepage of the sweepstakes microsite (www.100daysofsunnymoments.com) and on the BIC Soleil Facebook page (http://www.facebook.com/home.php#!/BICsoleil). You can also opt in to receive Planned Sunny Moments reminders throughout the Promotion period via Facebook by "liking" the BIC Soleil Facebook page during the registration process. You will be reminded about each Sunny Moment prior to its start via postings on the BIC Soleil Facebook page. Limit one entry per Planned Sunny Moment per person, per e-mail address. Entries for the daily Planned Sunny Moment must be received during the daily entry period in order to be eligible for that daily drawing. Non-winning daily entries for Planned Sunny Moments will not be carried over to subsequent Planned Sunny Moments. Participants must re-enter for the next Planned Sunny Moment to be eligible for a chance to win a Planned Sunny Moment Prize.

Spontaneous Sunny Moments (Surprise Prize): During the Promotion Period there will be ten (10) total Spontaneous Sunny Moments where you will be able to enter into the corresponding prize drawing. You may choose to enter/participate in that particular Spontaneous Sunny Moment or not. Each Spontaneous Sunny Moment will last four (4) hours and take place on various days and at various times. Spontaneous Sunny Moments will be announced thirty (30) minutes prior to its start via the BIC Soleil Facebook page only. You can opt in to receive Spontaneous Sunny Moments alerts via Facebook throughout the Promotion Period during the registration process by liking the BIC Soleil Facebook page. Additionally, two (2) of the Spontaneous Sunny Moments prizes will be determined by BIC Soleil Facebook fans via a poll that will be posted one 1 week prior to the announcement of that Spontaneous Sunny Moment. The poll will take place on Facebook and will require that you accept the Application to run the poll. The prize with the most votes will be the one given away. Limit one vote per person, per e-mail address, per Spontaneous Sunny Moment. Limit one entry per Spontaneous Sunny Moment per person, per e-mail address. Entries for the Spontaneous Sunny Moments must be received during the entry period specified when the Spontaneous Sunny Moment is announced in order to be eligible for that day's drawing. Non-winning daily entries for Spontaneous Sunny Moments will not be carried over to subsequent Spontaneous Sunny Moments. Participants must re-enter for the next Spontaneous Sunny Moment to be eligible for a chance to win a Spontaneous Sunny Moment Prize.

Grand Prize Sunny Moment (Grand Prize): For the first ninety-nine (99) days of the promotion, May 1, 2011 - August 7, 2011, you can enter for the chance to win the Grand Prize once per day. Limit one Grand Prize Sunny Moment entry and vote per day, per person, per e-mail address.

On the one-hundredth (100th) day of the promotion, August 8, 2011, you can enter to win the Grand Prize by participating in the Final Grand Prize Sunny Moment. You can enter the Final Grand Prize Sunny Moment one time during the entry period. Upon entering, your entry will be automatically multiplied to be worth ten (10) entries total into the Grand Prize drawing. The Final Grand Prize Sunny Moment will last twenty-four (24) hours, from 12:00:00 a.m. ET - 11:59:59 p.m. (ET) on August 8, 2011. You will be reminded about the Final Grand Prize Sunny Moment via postings on the BIC Soleil Facebook page (http://www.facebook.com/home.php#!/BICsoleil) you opted in for by "liking the page" during the registration process. Limit one Final Grand Prize Sunny Moment entry per person, per e-mail address.

While entering for the Grand Prize, you will have the chance to vote once per day, on one of two trip options to determine the trip that the Grand Prize winner will take. Voting for the Grand Prize will take place on promotion website (www.100daysofsunnymoments.com) and will require you to register for the promotion. Voting will end on August 8, 2011 at 11:59:59 pm. Voting on one of two trip options for the Grand Prize is optional and not required to enter the Grand Prize Sunny Moment drawing.

Entries into the Planned Sunny Moments, Spontaneous Sunny Moments and the Grand Prize Sunny Moment drawings are separate steps. Entries into one drawing do not automatically enter you into the other drawings.

4. PRIZES: SUNNY MOMENTS PRIZES: GRAND PRIZE SUNNY MOMENT (1): One (1) Grand Prize winner will receive a trip for two (2) to a beach house in Ambergris Caye, Belize, OR Mykonos, Greece. Grand Prize Winner will be awarded the trip that has received the most votes at the end of the Promotion Period. Trip to Belize will include roundtrip coach air travel for winner and one (1) guest from a major metropolitan airport close to the winner's home to Belize, eight (8) days and seven (7) nights beach house accommodations, roundtrip ground transportation to/from the airport to the winner's home, ground transportation to/from Belize airport and beach house in Belize for the Grand Prize Winner and guest and $1,000 spending money (for winner only). PLANNED SUNNY MOMENTS / SPONTANEOUS SUNNY MOMENTS / GRAND PRIZE SUNNY MOMENT ENTRIES: Sponsor and its subsidiaries, parent companies, affiliates and/or agencies are NOT responsible for lost, late, incomplete, illegible entries, computer errors; failures in servers or other connections or communications; or other errors of any kind nor for any injury or damage to an entrant's or other person's computer related to or resulting from participation in the Promotion. Sponsor will not be responsible for any alert or notification failure resulting in a lack of entry or inability to enter. All entries become the sole property of Sponsor and will not be returned or acknowledged. All entry information will be held and used in accordance with Sponsor's privacy policy (http://www.feelthesoleil.com/home/#/home). In the event of a dispute concerning who submitted an e-mail entry, the entry will be declared to have been made by the authorized account holder of the e-mail address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted e-mail address.

6. WINNER SELECTION: PLANNED SUNNY MOMENTS / SPONTANEOUS SUNNY MOMENTS / GRAND PRIZE SUNNY MOMENT PRIZE(S): Winners of Planned Sunny Moments and Spontaneous Sunny Moments prizes will be randomly selected from among all eligible entries received at the end of each daily Moment throughout the Promotion Period. The Grand Prize Sunny Moment prize will be randomly selected on or about August 12, 2011. The odds of winning depend on the number of eligible entries received. All Planned Sunny Moments / Spontaneous Moments prizes will be shipped via UPS within six to eight (6-8) week's time upon verification of winning throughout the duration of the Promotion unless otherwise indicated. Planned/Spontaneous Sunny Moments Prizes: Winners will be notified via e-mail within 72 hours of being drawn. Notification e-mails to potential winners of prizes with an ARV of $600 and above will also include an Affidavit of Eligibility/Release of Liability Form, and where legal, Publicity Release, which is subject to verification, and must be executed and returned within seven (7) calendar days of receipt. Non-compliance within this time period or return of Affidavit of Eligibility/Release of Liability Form as undeliverable may result in disqualification and an alternate winner will be randomly selected. Grand Prize Sunny Moment: Winner will be notified via phone and e-mail on or about August 15, 2011. If potential winner cannot be reached or fail to respond for a period of seven (7) calendar days following first attempted notification, prize will be forfeited and an alternate winner will be randomly selected. Potential Grand Prize winner will be sent via e-mail an Affidavit of Eligibility/Release of Liability Form, and where legal, Publicity Release, which is subject to verification, and must be executed and returned within seven (7) calendar days of receipt. Non-compliance within this time period or return of Affidavit of Eligibility/Release of Liability Form as undeliverable may result in disqualification and an alternate winner will be randomly selected.

No substitution, transfer or cash redemption of prizes permitted, except at Administrator's discretion. All federal, state and local taxes, and other charges, if any, are the sole responsibility of the winner. All potential winners of prizes with an ARV of $600 and above will each be issued a Form 1099-MISC. Limit two (2) daily prizes (any combination of Planned Sunny Moment Daily prizes and/or Spontaneous Sunny Moment prizes) per person, per e-mail address. Winners of two (2) Planned or Spontaneous Moments prizes are also eligible to win the Grand Prize.

Vespa Prize will be delivered to winner's home within the fifty (50) United States and the District of Columbia. Winner is responsible for all taxes and expenses (excluding sales tax), including but not limited to: registration, title and license fees, insurance, additional equipment and all other costs incurred in registering, titling or using the Vespa. Vespa is delivered solely with the express limited warranties provided by Vespa/Piaggio USA. and winner shall look solely to those entities for any warranty issues. Sponsor in its sole discretion may elect to substitute another Vespa of a similar look, color or model and style in the event of scarcity due to limited production or unavailability for any other reason. Vespa will be released only upon proof of satisfactory proof of insurance.

If any prize becomes unavailable, Sponsor reserves the right to substitute another prize of equal or greater value. By entering Promotion, entrants agree to abide by and be bound by these Official Rules and the decisions of Sponsor and Administrator, which shall be final and binding in all respects. Acceptance of prize offered constitutes permission to use the winners' name, likeness and/or photograph, town, state and statements for advertising/trade purposes in any and all media, and all media now or hereafter known worldwide, without further compensation, notification or permission, unless prohibited by law. By participating, winners release Sponsor and its parent companies, affiliates, subsidiaries, distributors, advertising and promotional agencies, the Administrator, and their respective directors, officers, employees and agents, from any and all liability with respect to all aspects of the Promotion, including any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in the Promotion or any Promotion-related activity or travel or from any interaction with, or downloading of, computer Promotion information. Entrants who do not comply with Official Rules or who attempt to interfere with the Promotion in any way shall be disqualified.

7. GRAND PRIZE TRIP: Potential grand prize winner and guest must be able to travel for eight (8) consecutive days and travel must be completed by July 31, 2012 or as required by the Sponsor to accept the prize. All other expenses not expressly stated herein are the sole responsibility of the Winner and their guest. Travel and lodging reservations must be made forty-five (45) days prior to planned arrival. Beach house accommodations will be selected and arranged by Administrator. Winner and guest must travel on the same itinerary and are responsible for obtaining all required medical clearances and travel documents including documents to travel overseas (e.g., acceptable photo ID, visa, passport) where applicable. Failure of Prize winner and guest to obtain proper travel documentation may result in cancellation and loss of travel prize. Sponsor will not replace lost, mutilated, or stolen tickets, travel vouchers or certificates. Winner's guest must be 18 years of age or older unless traveling with a parent or legal guardian. Travel and lodging are subject to availability, certain restrictions and blackout dates may apply. Meals not included. All taxes are the sole responsibility of Winner. Prize cannot be sold, transferred or bartered in whole or in part and no substitutions or cash equivalents allowed, except at the sole discretion of the Sponsor, who reserves the right to substitute a prize of comparable or greater value. All details of the prize shall be determined solely by Sponsor.

8. ELIGIBILITY: The Promotion is open to residents currently residing in the fifty (50) United States and the District of Columbia, 18 years of age or older at the time of entry. Persons in any of the following categories are NOT eligible to win a prize: (a) Employees or agents of Sponsor and Administrator and their parent companies, subsidiaries, affiliates, distributors, subsidiaries, advertising and promotion agencies, (b) individuals engaged in the development, production or distribution of materials for the Promotion; and (c) persons who are in the immediate family of any person in any of the preceding categories (including mother, father, sister, brother, daughter, son, spouse, grandmother, grandfather, children or grandchildren), regardless of where they live; or persons who reside in the same household, whether related or not, as any person in any of the preceding categories. All federal, state and local laws and regulations apply. Void where prohibited, taxed or restricted by law.

9. PROMOTION INTEGRITY: Individual Entry Only. Every entry submission must be manually key stroked and manually entered by the individual entrant. Automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or sweepstakes service) will be disqualified and transmissions from any related e-mail or IP addresses may be blocked. Entries submitted by any other individual or any entity originating at any other Internet web site or e-mail address, including but not limited to commercial sweepstakes subscription notification or entering service sites, will be declared invalid and, as such, ruled ineligible for this promotion. Sponsor may reject any entry it believes is the result of fraud or was submitted in violation of the Official Rules. A "screen shot" is not evidence of winning a prize.

If by reason of a printing, computer, production or other error, more prizes are claimed than the number set forth in these official rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded.

Sponsor reserves the right to suspend or terminate the Promotion, if in Sponsors sole discretion; the Promotion becomes infected or otherwise corrupted. If for any reason the Internet portion of the Promotion is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor, which corrupts or affects the administration or proper conduct of this Promotion, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify or suspend the Promotion or any element thereof. The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly is prohibited. Any entries found or suspected to be submitted in this manner will be deemed void by the judges.
