If possible, I always buy at least two of whatever used item, that way I can keep the best and return the rest.
I'm surprised you've gotten brand new items under acceptable condition since usually there are very specific descriptions of the condition of the item including scratches and whether it comes with the original box or not. Did the items you bought have descriptions detailing damage. I've received new items under like new but never under acceptable.

If you have the time it might be "fun" to try but going out and returning them is a hassle in my opinion and very much a waste of my time. I stopped buying warehouse for these reasons as 70% of the time I'd be returning the item
For instance, I bought this item [amazon.com] in used acceptable condition the other day for like $10, and it arrived brand new. The box was a bit beat up, so maybe that is the "scuffs" they refer to? A majority of the time, it is the packaging itself that might have scuffs, but the product is brand new.
