If you need the extra battery, search for the ryobi 6ah 2 pack for 159.99, add the 2 pack 2ah. Return the 2ah batteries, keep the 6ah for 87.78…for killer deal. 3 hp batteries (4ah comes with saw + 2x6ah) and a saw for $240

Since when returning an unused product a fraud? It's a legally protected consumer right. if they don't want us to return it, they could have made a combo price and not two separate prices (i believe Lowe's does it for their combo sales).

This actually is fraud, and Home Depot says they will give you the lowest advertised price as store credit, which at minimum would be the prorated price you paid but could be lower.
