That may be true in this case, but you can't use that as a general statement. Usually tools are engineered just to spec, i.e. you don't over-engineer just to "be safe"; you have to stay competitive. If you built it to spec of materials, you're likely safe from lawsuits like you describe.

They have a safety %. Built in im a little over 300 and have used ladders rated at 225 with no issues. Obviously id rather be on ladders rated at 300 but sometimes thats not an option. Personally id trust 20% over anything above that your risking it.
