From the comments of Q&A, someone got it with 3 batteries
Also, look at the Model # for this deal, 2804-22-48-11-1850. That is the 2804-22 kit that comes with two batteries plus the 48-11-1850 which is the third battery.
The info on the product page is probably just for the 2804-22 kit.
PS This seems like a very good deal with the batteries. Assuming you need the hammer drill. The hard case is a bonus for some as well; though for me I prefer soft bags or my own larger tool chests that can keep multiple tools together.

These Home Depot sales discrepancies are frustrating. They have the M18 Fuel 1" SDS Rotohammer on sale for $149.. and it clearly states that it comes with 2 9ah Batteries. The price would be too good to be true, and I don't even know what 9ah battery currently exists, but when I asked at the store they were clueless. I went ahead and ordered, will see what comes. I'll just return it if it's bare tool, and give the MOD an earful.
Edit: just checked the product listing today, and they have updated it to say tool only. Good thing I have screen shots, as well as the email order confirmation that clearly states it comes with (2) 9ah batteries.
