Problem with landscaper

Hi everyone,
I have been a long-time user of this forum and am very impressed with the cumulative knowledge presented here. I am presenting my situation here in hope that the fellow SDers may have a solution or advise for me. I am not sure if this is the right forum so please move it to the appropriate one if you see fit

I bought a house and wanted to do some small landscaping improvement. I asked around and somebody gave me a name and phone number of a guy who contracts landscaping in the area. I called the guy up and he came and gave me an estimate of $3,500 for the landscaping. It includes redoing the existing 3 planters and put shields between the planters and the house, plant 3 full-size King palms in 2 different areas with flower beds under the trees, plant 7 Queen palms and flower beds, run irrigation system with automatic controller throughout the yards, create a 5' wide walk-way of stamped concrete for bringing the trash in and out of the yard, and finally fill the yard with mulch. He also indicated that he would take care of all the little extra things to make sure that it look great to my satisfaction. He will provide everything including trees, flowers, mulch, concrete, hauling dirt in and out, all inclusive. He told me he will complete in 3 days. He said that he is just glad he has a job in this economy. He sounds nice and the deal appears to be good so I accepted it. He said that it is a small job and I really don't need to create a formal contract. He asked for $1,000 deposit and I gave it to him.
The next day, he already had the yard dug up multiple holes "in preparation for tree planting" and laid down irrigation pipes. At this point, he asked for $500 more to buy the trees. I gave it to him. He stated that the yard is so large that I needed to fill-in with fruit trees to make it nicer but it was not in the agreement so I had to pay for them. I went ahead and bought 14 small fruit trees and gave it to him and he planted the same day. At this point, he stated that he needed $700 more to buy the mulch and pay for the concrete and he would finish the job the next day. Impressed with everything so far, I gave him $700 as he asked.

Over the next few days, he no showed. I called him on several occasions and he states that he will get it done the next day but again, no showed. This continues over the next several weeks of no-show. I have contacted him many times over the phone and messages. He started not answering the phone and occasionally when I do get him, he always apologized and states that it will be done that same weekend. Well, it has been 6 weeks and by now I realize that he will never come.

To summarize: I paid a guy who I only know his first name and phone number so far $2,200 and he only laid down water pipes and planted some trees that I bought, then now stopped coming. I know, I should have known better and got a written contract but I really thought that it was a small job and the guy was so happy just to have a job in this economy. Anyhow, I am at this point so furious at the guy lying so blatantly knowing that he is not coming, leaving me dragged on forever while my yard is all dug up and ugly. I have decided to hire another contractor this coming weekend to finish the job. I, however, wanted to know from my fellow SDers if there are anything I could do to get the guy to pay back. Or at least track him down and warns others about this guy. Your help is well appreciated. Sorry for the long post but I wanted to present all the details.

No, they are NOT workers. That is what I meant by "not exactly yard worker type of people". I just know them. They are my people.

Ah, I see your point. May be I have a bad habit of sounding big. Gotta watch for that. No, They don't work for me. I meant I can depend on them to take the picture if they see him.

Just learned from someone that he took her $800 too. Well, less hope for me then. This guy is a pro at this. Someone stop him. I will try to post his info on the net so people will be aware, once I know more though!!!

Her who? And how is a 4 yr old going to take a Photo that is clear enough for you to make out a license plate? Is the 4 yr old that good with a camera?

Always, always getting written contracts for any type of work being done at your home.

Sounds like you have one excellent con man on your hands - and you need a village to round up a posse to find this guy - and settle things with "him" - the old fashioned way Wink

Of course it is the adult that takes the picture. Why is everyone get hooked with the 4 yo kid? I was just trying to say that these people know nothing about yard work.

The lady who got con for $800 was actually looking for him to settle it that way. The way it is going, he will pay one way or another.

In our neck of the woods (suburbs) we find these types of people, and we deal with it; so it doesn't happen again - and we don't necessarily turn it over to the "law" as they might not be as effective as "the village" may be in dealing with it - it all depends on who exactly was "ripped off" - as to how it's dealt with - certain people definitely would never turn it into the "law" to handle...


Btw - you brought the 4 yr old into the picture - not us Nono2

Does the lady know his last name? or the person who originally recommended him in the first place? Be sure to talk to the person who did the recommendation and let them know how bad the guy is.

Lessons hard learned .Same things happen after a tornado or flood contractors come from every where folks think they look honest without doing proper checking.
We had a landscape project done after the drought, last spring. We got 3 bids with very specific instructions. Replace front bed shrubs with azaleas Encore, build a back bed along the back fence 10 Encore veragated grasses.Refresh shape other beds with dirt and mulch. 2 bids were folks that lived in our neighborhood. We knew them as neighbors, and they lived in our subdivision. One was a landscape company in the city been around 15 + years with good standing with better business bureau a real store front that has been there a long time they were also the most expensive.
We went with the neighbor down the street. The project went well . Most of the plants survived the very hot summer. However i noticed as we had to re place a few he got George Tabur but not the Encore we had a written contract for.
Had i seen that i would of not let him plant those back spring. Encore bloom several times a year more hardy , where as George Tabur only bloom once a year
It is a lesson we all learn. Take your time do your home work, get bids do not always go with the cheapest.
We had a signed contract with a picture of his drivers licensee attached to contract. We also verified he was licensed and insured ( bonded ) .
While the beds look nice 8 months latter, i should of checked what he was putting in the ground.
We did replace 4 shrubs along the side with Encore.
I wish you well with the next project. Only thing you can do now, is report him to local police * if you have anything in writing* take pictures.
I wish you better luck with next project, next time get bids in writing , verify addresses , have more then a cell phone number and check references.
