well we got back from the orthopedic surgeon - he is not to put any weight on it for 10 weeks. In order to work he has to wear steel toe boots - so I am 99.9% positive that he is going to loose his job because of this.

That would be illegal! The FMLA is there for people like your hubby.

I don't know what state you're in but you probably have something similar to temporary disability insurance (TDI) like we have in RI. Check your state labor laws.

Very true. However, there are stipulations with FMLA. Like you must have worked there for at least a year, the company must have a certain number of employees, and a few others I can't remember right now. However, you should check into your rights before something comes down the line.

FMLA only covers him for 12 weeks. I work with Federal Labor Laws. 12 weeks is definitely better than a kick in the pants. The big concern is disability pay during this time.

Thanks for the info - He has 2 good friends from the company (one that had knee surgery and one that had a baby) When they came back to work both were told that their position had already been re-filled. I know that both of those people are in process of having a law suit filed against the company.

He has been there for 2 years now I think, and its a pretty big company.

Yes, I know. I'm pretty sure the company has to have 50 employees to qualify. I offer this info because she seemed quite distraught and I wanted her to know just because he was hurt it didn't equal an immediate firing.

Yup, which would work for them since she said 10 weeks. Hopefully, like I said, they have TDI or some type of short term disability available.

Well, hopefully they won't be stupid enough to do it a third time! It sounds like those two were well within their rights and should not have been let go. Please check into your state laws. Good luck!

Maybe it's a good thing that the 2 friends have started the law suit process. Hopefully they'll get their act together before your DH returns to work.

I just got back from Target where my cashier totally tried to pocket my gift card... It was odd, whenever my coupons beeped item not found, she put $12.99 for the coupon! Even when it was toothpaste or a toothbrush or something! Even after I told her it was $3.79... I was like ,whatever until after I paid, I noticed she took my gift card with $50 still on it into her drawer. When I said something she was like, "Oh, I thought it was empty.." and then she made like she was looking for it in the wrong part of the drawer.. I was like, "Umm, I think you put it over there" Roll Eyes (Sarcastic)

Same cashier proceeds to tell me about how some asshat came in there and bought $5,000 worth of stuff and paid like $200... Really? Seriously? $5,000??

You're right...I was too lazy to look it up. Wink

To be eligible for a leave, an employee must have worked for the employer at least twelve months and must have worked at least 1,250 hours during the twelve month period preceding the commencement of the leave. He can apply other accrued paid time off (such as sick or vacation time) to FMLA leave.
