1. First, andmost importantly, it's their current console. Of course they'd care much more about something that make piracy easy, costs them money and makes their hardware look like the joke it is.
2. Yuzu used decryption to operate, using the decryption keys & posting walkthroughs and links on their site along with the emulator was a mistake. Most emulators reverse engineer the hardware and use unencrypted roms.
The second you start making money off an emulator you risk this happening.

They can do whatever the heck they want, there won't be any new 3ds games, the works for a 3ds emulator at this stage of the system is mainly maintenance and porting to other new platforms, there will be plenty of people will and can do those works

Oh man. I got my dreamcast and I hear it's a treat to mod.
I think Yuzu making money was of secondary concern to them. The bigger issue is... why would you buy a Nintendo Switch when you could just get an emulator instead? The existence of Yuzu discourages some people from buying Switches.
At some point, Nintendo will release a 4K port of BOTW and TOTK on Switch 2. Why would a person buy a remaster on Switch 2 when they could just use Yuzu to run the Switch versions of BOTW and TOTK at 4K?
Casual people are not going to use emulators. People that enjoy the portability of the Switch are not going to use Yuzu. But there is probably a fairly significant pool of hardcore PC gamers that will flat out use Yuzu instead of ever buying a Switch (and they'll also pirate a bunch of games to boot).
I am a huge advocate of emulators. But emulating modern and current consoles leads to enormous amounts of piracy. Downloading a ROM of Super Mario World is a lot different than downloading a dump of TOTK a day after it's released.
